By accessing and using cuts.ly ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

cuts.ly provides URL shortening services that allow users to create shortened versions of long URLs. The Service is provided free of charge for basic usage, with premium features available for registered users.

3. User Conduct

You agree not to use the Service to:

• Shorten URLs that link to illegal content, including but not limited to child pornography, pirated content, or content that violates intellectual property rights
• Distribute malware, viruses, or any other malicious code
• Engage in phishing, scamming, or fraudulent activities
• Spam or send unsolicited messages
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Harass, abuse, or harm another person
• Impersonate any person or entity

4. Link Expiration

Free (non-registered) users' shortened URLs will expire after 15 days. Registered users' URLs do not expire unless the user chooses to delete them or violates these Terms of Service.

5. Rate Limiting

To ensure fair usage and service availability, rate limits are applied to all users. Free users are limited to 1 request per second. Excessive usage may result in temporary or permanent suspension of service.

6. Content Removal

We reserve the right to remove any shortened URL that violates these Terms of Service without prior notice. We also reserve the right to suspend or terminate user accounts that repeatedly violate these terms.

7. Privacy and Data Collection

We collect and process data as described in our Privacy Policy. By using the Service, you consent to such processing and you warrant that all data provided by you is accurate.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by cuts.ly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

In no event shall cuts.ly, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless cuts.ly and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
